El 29 de octubre de 1997, el Secretario de Transporte, Rodney Slater, y el Presidente de la Junta Nacional de Seguridad en el Transporte (NTSB, por sus siglas en inglés), James Hall, presentaron al Vicepresidente Gore y al Congreso el Informe final del Grupo de trabajo sobre Asistencia a familias en caso de catástrofe aérea. Este informe contiene 61 recomendaciones, casi todas ellas unánimes, que ayudarán a mejorar el trato recibido por los sobrevivientes y familiares de las víctimas de catástrofes aéreas. Los invito a analizar cuidadosamente este informe, cuya copia se adjunta, y a poner en práctica las recomendaciones dirigidas a las compañías de transporte.
El ex Señor Secretario de Transporte, Federico Peña, y el Señor Presidente James Hall les enviaron con anterioridad una carta en la que les informaban acerca de la Ley de Asistencia a Familias en Caso de Catástrofe Aérea (Aviation Disaster Family Assistance Act) de 1996. La ley exige, entre otras cosas, que todas las compañías aéreas certificadas elaboren y presenten al Departamento y a la NTSB un plan para responder a las necesidades de los familiares de los pasajeros, empleados o terceros que hayan sido víctimas de accidentes de aviación.
El Departamento y la NTSB han recibido los planes presentados por ustedes. Estamos seguros de que comprenderán que los planes recibidos difieren de manera considerable en contenido, enfoque y detalle. Nuestra revisión inicial sólo se ha concentrado en verificar si los planes incluyen todas las garantías exigidas por la ley. Si bien hemos “aceptado” todos los planes recibidos, esto no constituye nuestra “aprobación”. Ahora, nuestra principal preocupación consiste en determinar si cada compañía de transporte ha comprometido, o estará en condiciones de comprometer, el personal y demás recursos necesarios para poner en práctica su plan de forma adecuada en caso de que ocurra un accidente.
Después de cualquier accidente, la NTSB realizará el seguimiento de la puesta en práctica por parte de la compañía de transporte en cuestión de las garantías establecidas en su plan. Si la NTSB determina que la compañía de transporte aéreo no ha cumplido con las garantías exigidas por la legislación y presentadas en su plan, la NTSB remitirá el asunto al Departamento. Investigaremos y adoptaremos medidas de cumplimiento cuando sea necesario. Esas medidas podrían implicar una orden de cese y desistimiento y en sanciones civiles o, en casos muy especiales, la modificación o revocación de la autorización de la compañía de transporte para operar. Además, las personas podrían estar sujetas a acciones penales en relación con cualquier declaración falsa realizada al gobierno federal.
El Grupo de trabajo sobre asistencia a familias en caso de catástrofe aérea, constituido por representantes de organismos del gobierno, compañías de transporte aéreo y familiares de víctimas de catástrofes aéreas, recomendó que todas las compañías de transporte aéreo consideren establecer acuerdos con terceros contratistas en caso de que una compañía de transporte no pueda o no esté en condiciones de prestar los servicios exigidos por la Ley de Asistencia a Familias en Caso de Catástrofe Aérea. Los insto enfáticamente a evaluar su capacidad para cumplir con sus obligaciones legales.
